Terms of Service, Data Processing Agreement, and Beta Addendum.

1. Introduction

PodProfits ("we", "us", "our") provides a profit monitoring and order management dashboard for Etsy sellers using print-on-demand services such as Printful and Printify. By creating an account or using PodProfits, you agree to these Terms.

2. What PodProfits Does (and Does Not Do)

We do

  • Read data from your Etsy, Printful, and/or Printify accounts with your permission via OAuth.
  • Calculate profit margins on your POD orders.
  • Display order status and analytics in one dashboard.
  • Store your data securely to power the dashboard.

We do not

  • Send data back to Etsy, Printful, or Printify beyond OAuth authentication.
  • Modify, create, or delete anything in your connected accounts.
  • Fulfill orders, print products, or handle shipping.
  • Provide customer support to your Etsy buyers.
  • Sell your data or share it with advertisers.

3. Eligibility

You must

  • Be at least 18 years old.
  • Have an active Etsy shop in good standing.
  • Have authority to bind any business entity you represent.

4. Account Registration

You provide your email address, name, and authorization for OAuth connections to your Etsy, Printful, and/or Printify accounts. You are responsible for maintaining account security, all activity under your account, and notifying us of unauthorized access.

5. Your Responsibilities

You remain solely responsible for

  • Compliance with Etsy's Terms of Use and Seller Policy.
  • Compliance with Printful's and Printify's Terms of Service.
  • The legality of your products and designs.
  • Customer service for your Etsy buyers.
  • All applicable taxes, including sales tax and VAT.

6. Read-Only Nature of PodProfits

PodProfits is a read-only application. We use OAuth tokens with the minimum necessary scopes to read your Etsy shop, orders, transactions, and your Printful or Printify order and fulfillment data.

We do not request or use write scopes. We cannot:

  • Create or edit Etsy listings.
  • Cancel or refund orders.
  • Update Printful or Printify products.
  • Change settings in your connected accounts.

If we add write features in the future, we will notify you in advance, request any needed OAuth permissions, and update these Terms before enabling them.

7. Fees and Payment

We may charge fees for using PodProfits. Current pricing is displayed on our pricing page.

We may change fees with 30 days' notice. Continued use after the effective date constitutes acceptance. You remain responsible for taxes applicable to your use of PodProfits.

8. API Usage and Third-Party Dependencies

PodProfits depends on the continued availability of the Etsy, Printful, and Printify APIs. We are not responsible for API changes, discontinuation, rate-limit throttling, downtime, or other errors caused by third-party services.

9. Data Processing and Privacy

Our Privacy Policy explains how we collect, use, and delete your data. By using PodProfits, you acknowledge that we act as a Data Processor for the Etsy seller data we access, process data only to provide profit monitoring and order management, notify you within 24 hours of a qualifying data breach, and delete your data within 30 days of account disconnection or deletion.

10. Intellectual Property

Your content, including product designs and shop data, remains yours. We claim no ownership over it. Our software, dashboard, analytics, and algorithms remain ours. You may not copy, reverse engineer, or resell PodProfits.

11. Termination

By you

You may delete your account at any time via Settings → Delete Account. Data deletion follows our Privacy Policy.

By us

We may suspend or terminate your access if you

  • Violate these Terms.
  • Violate Etsy, Printful, or Printify policies.
  • Use PodProfits for fraudulent or illegal activity.

Effects of termination

  • All OAuth tokens are revoked.
  • All your data is deleted within 30 days.
  • You remain responsible for any fees incurred before termination.

12. Support

Support is available via email at support@podprofits.app. If you later add in-app chat, update these Terms accordingly. Our current response target is within 24 to 48 business hours. We do not provide support to your Etsy customers.

13. Disclaimer of Warranties

To the fullest extent permitted by law, PodProfits is provided "AS IS" and "AS AVAILABLE." We do not guarantee uninterrupted service, error-free operation, perfect profit calculations, or fitness for your specific business needs.

We are not liable for

  • API changes or downtime from Etsy, Printful, or Printify.
  • Incorrect data supplied by third-party sources.
  • Business decisions you make based on PodProfits analytics.

14. Limitation of Liability

To the fullest extent permitted by law, PodProfits will not be liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data. Our total liability will not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

15. Indemnification

You agree to indemnify PodProfits from claims arising from

  • Your violation of these Terms.
  • Your violation of Etsy, Printful, or Printify policies.
  • Your products, designs, or customer disputes.
  • Your infringement of third-party intellectual property rights.

16. Modifications to These Terms

We may update these Terms. Material changes will be announced by email or in-app notice at least 14 days in advance. Your continued use after the effective date constitutes acceptance.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of [Your State/Country].

Dispute Resolution

  • Option A: Binding arbitration in [Your City], with waiver of jury trial and class action rights.

18. General Provisions

Data Processing Agreement (DPA) Effective Date: [Date]

  • PodProfits ("Processor", "we", "us")
  • You, the Etsy seller ("Controller", "you")

1. Scope and Purpose

This Data Processing Agreement ("DPA") forms part of the PodProfits Terms of Service and Privacy Policy. It governs the processing of personal data we handle when you connect your Etsy, Printful, and/or Printify accounts.

Purpose of processing

  • Provide profit monitoring and order management analytics.
  • Read connected account data and display it in a unified dashboard.

Nature of processing

  • Read-only data collection.
  • Secure storage.
  • Analysis and display.

2. Roles

You are the Data Controller because you determine why and how your customers' personal data is collected through Etsy, Printful, and Printify. PodProfits is the Data Processor because we process that data only on your instructions, as defined by these Terms and this DPA.

Under Etsy API Section 4, you acknowledge that PodProfits acts as a service provider to you, the Etsy seller.

3. What Personal Data We Process

We process the following categories of personal data

  • Customer identifiers, such as name, shipping address, and email address from Etsy orders.
  • Transaction data, such as order amounts, fees, taxes, and shipping costs.
  • Product data, such as listing titles, SKUs, and variant details.
  • Shop data, such as your shop name, shop ID, and payout information.

We do not process

  • Customer payment information such as credit cards or bank accounts.
  • Passwords or login credentials.
  • Data you have not explicitly authorized via OAuth.

4. Processor Obligations

PodProfits agrees to

  • Process data only on documented instructions.
  • Keep personnel access confidential.
  • Maintain encryption in transit and at rest.
  • Manage subprocessors with equivalent protections.
  • Notify you within 24 hours of discovering a breach involving your data.
  • Delete personal data within 30 days of disconnection or deletion.
  • Maintain GDPR compliance documentation and periodic audits.

5. Your Instructions

By using PodProfits, you instruct us to:

  • Read order, transaction, product, and shop data from your connected accounts.
  • Store that data in our Cloudflare D1 database, including EU-restricted storage where required.
  • Analyze the data to calculate profit margins and generate analytics.
  • Display the data and analytics to you in the PodProfits dashboard.
  • Delete the data within 30 days of account disconnection or deletion.

You do not instruct us to

  • Send data back to Etsy, Printful, or Printify beyond OAuth authentication.
  • Modify, create, or delete anything in your connected accounts.
  • Share your data with third parties except as needed for hosting and service delivery.

6. Subprocessors

PodProfits uses the following subprocessors

  • Cloudflare, Inc. for hosting, Workers, and D1 database services. GDPR safeguards include SCCs and a DPA.
  • Etsy, Inc. as a read-only source of shop and order data.
  • Printful, Inc. as a read-only source of fulfillment data.
  • Printify, Inc. as a read-only source of fulfillment data.

Note: Etsy, Printful, and Printify are independent data controllers for their own systems. They are listed here for transparency because you instruct us to read data from them.

Changes to subprocessors

We will notify you at least 30 days before adding or replacing a subprocessor. You may object by deleting your account before the change takes effect.

7. International Data Transfers

We rely on the following safeguards

  • Cloudflare D1 databases restricted to the EU where required.
  • TLS encryption when data is displayed in your dashboard.
  • Standard Contractual Clauses or equivalent mechanisms offered by Etsy, Printful, and Printify when data is transferred from their systems.

8. Data Breach Notification

If we discover a breach affecting your personal data, we will notify you within 24 hours using your registered email address. We will provide a description of the breach, the categories and approximate number of records affected, mitigation steps taken, and a contact person for follow-up.

We do not notify your customers on your behalf. That remains your responsibility as Data Controller.

9. Data Deletion

Deletion timelines

  • Disconnecting a single platform: platform-specific data deleted within 30 days.
  • Deleting your PodProfits account: all personal data deleted within 30 days.
  • Immediate deletion by email: acknowledged within 48 hours and completed within 14 days.
  • Termination for Terms violations: personal data deleted within 30 days.

After deletion, aggregated de-identified analytics may be retained.

10. Data Subject Requests (DSARs)

If one of your customers requests access, correction, or deletion of their data:

  • Requests sent to you are your responsibility to handle as Data Controller.
  • Requests sent directly to PodProfits will be forwarded to you within 5 business days.

We will not respond directly to your customer without your authorization.

To request help locating data in our systems, email privacy@podprofits.app with the subject line: DSAR Request — [Your Shop Name]. We respond within 30 days.

11. Audits and Compliance

PodProfits maintains records of processing activities, security procedures, and subprocessor agreements. You may request one GDPR compliance audit per calendar year at your own expense, subject to a signed confidentiality agreement.

12. Liability

PodProfits liability is limited to the amount you paid in the 12 months preceding the claim, or $100 USD, whichever is greater, as stated in the Terms of Service. You remain responsible for your own compliance obligations to Etsy, Printful, Printify, and your customers.

13. Governing Law

This DPA is governed by the same law as the PodProfits Terms of Service.

Beta-Specific Addendum Effective Date: [Date] Beta Period Ends: [Date when beta ends]

This Beta Addendum ("Beta Terms") applies to your use of PodProfits during the beta testing period. It supplements the PodProfits Terms of Service, Privacy Policy, and Data Processing Agreement. If there is a conflict, these Beta Terms control during the beta period.

1. Beta Purpose

PodProfits is currently in beta. That means:

  • We are still testing features, performance, and stability.
  • You are an early user providing valuable feedback.
  • Features may change and the service may occasionally break.

By participating in the beta, you agree to help us improve PodProfits by reporting bugs, issues, and suggestions.

2. No Charge During Beta

PodProfits is free during the beta period. We do not charge new beta users for access.

Exception

If you are already on a paid plan that predates the beta, those existing terms still apply.

3. Beta Stability and Performance

During beta, you can expect occasional bugs, feature changes, downtime during updates, and delays caused by Etsy, Printful, or Printify APIs. You should not expect perfect reliability, guaranteed uptime, or real-time flawless synchronization.

4. Feedback License

By using PodProfits beta, you agree to provide reasonable feedback when requested. Any suggestions, feedback, or bug reports you submit may be used by us to improve PodProfits without compensation to you.

We will not publicly attribute your feedback to you without your permission.

5. Data Deletion After Beta

When PodProfits exits beta

  • If you continue using the service, your data remains and we will notify you in advance of any pricing changes.
  • If you do not wish to continue, you may delete your account and your data will be deleted within 30 days under the Privacy Policy.

We will not automatically delete your data when beta ends. You must choose to delete your account if you do not want to continue.

6. Beta Duration

The beta lasts until

  • We announce the end of beta by email and in-app notice, or
  • [Specific date], whichever comes first.

We will give at least 14 days' notice before ending the beta and moving to a paid model, if one is introduced.

7. Beta Support

During beta, support is available via:

Target response time

  • Within 48 hours.

Bug fixes and critical issues take priority over feature requests during beta.

8. No Warranties

To the fullest extent permitted by law, PodProfits beta is provided "AS IS" with all faults. We do not guarantee accurate profit calculations, uninterrupted availability, or prompt bug fixes.

Do not rely on PodProfits beta for mission-critical business decisions without verifying data directly in Etsy, Printful, or Printify.

9. Early Access Features

We may provide access to features that are not fully documented or fully tested. These Early Access Features may change or disappear without notice and may have lower reliability than other beta features.

10. Beta Program Termination

We may end the beta program at any time. If we do:

  • We will try to give at least 7 days' notice.
  • You may request a data export before the beta ends by emailing beta@podprofits.app.
  • All data will be deleted within 30 days unless you migrate to an available paid plan.

11. No Compensation for Beta Participation

Beta participation is voluntary. Unless we explicitly agree otherwise in writing, you are not entitled to compensation, equity, discounts, or other benefits for participating.

12. Confidentiality

If we share non-public information with you during beta, such as unreleased features, pricing plans, or internal metrics, you agree to keep that information confidential and not share it publicly or with competitors without written permission.

13. Acceptance

By checking "I agree to the Beta Addendum" during signup, or by using PodProfits during the beta period, you accept these Beta Terms.
